SEXUAL OFFENCES AGAINST CHILDREN AND IMPACT OF POCSO ACT IN INDIA

Abstract
The victims of the sexual abuse are the children, and they need to be better protected against sexual offences.It should be noted that the psychology of children at this difficult age is very precarious and they are unable to resist sexual offences committed on them by the accused. According to Article 17 of International Covenant on Civil and Political Rights, 1966 it is the duty of the State to safeguard each person through legislation.Children shall be safeguarded through legislation from infringement and from problems .that sexual offences against children are the violation of their fundamental rights.That in this research problem, in review of literature these are included, quoting the International Covenants. The Constitution of India, The Protection of Children from Sexual Offences Act,2012 and other relevant laws protect the rights of children against sexual offences. Recommendation of Law Commission of India, Report of theStanding Committee of Parliament,History on sexual offences against children which are available in relevant books, all support the protection of children against sexual offences. For empirical research, the researcher has consulted two expert groups i.e.(i)Group of Police Personnel and(ii) Counsel Group from five District of Rajasthan State through approved Questionnaire.Thedata analysis is done by detailed examination of the doctrinal research and empirical research and finally conclusion is drawn as that of failure of efficient machinery(Court of Justice,Police administration and lack of Political will) as important factors to the increasedsexual offences against children in India.
